Terms of Service

1. Agreement to Terms

By downloading, installing, or using Daybound Tower ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Service Description

Daybound Tower is a health-driven tower climbing RPG for iOS. The App reads HealthKit data (steps, stairs, distance, workouts) from the previous day to generate daily game parameters. Core features include:

• Daily tower climbing simulation
• Equipment collection and management
• Passive skill unlocking
• Player progression and mastery levels

3. User Data

All game progress is stored locally on your device. We do not operate servers or maintain user accounts. You are responsible for your own device backups. Data loss due to device failure, app deletion, or OS updates is not recoverable by us.

4. HealthKit Usage

The App requests read-only access to HealthKit data including step count, flights climbed, walking/running distance, and workout records. This data is used solely to generate in-game parameters and is never transmitted off your device.

5. In-App Purchases

The App offers the following in-app purchases:

• Pro Unlock (one-time, non-consumable) — Expands equipment drops, inventory slots, and passive skill slots. Does not affect combat mechanics.
• Tip Jar (consumable) — Optional tips to support development. Grants a cosmetic badge with no gameplay effect.

All purchases are processed by Apple through the App Store. Purchases are final and non-refundable unless required by applicable law. Non-consumable purchases can be restored at any time via the "Restore Purchases" button in Settings. The App is fully playable without any purchases.

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use automated tools or scripts to manipulate the App
• Exploit bugs or vulnerabilities for unintended advantage
• Redistribute or resell the App or its content

7. Intellectual Property

All content, design, code, and assets in Daybound Tower are the property of the developer. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Disclaimers

The App is provided "as is" without warranty of any kind. We do not guarantee that the App will be uninterrupted, error-free, or that defects will be corrected. The App is not a medical device and should not be used as a substitute for professional health advice.

9. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data or progress.

10. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Termination

We may terminate or suspend access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law provisions.
